Lawful development certificate appeal success

Following a 12 month lawful development certificate appeal, we were pleased to advise our property management company client that a lawful development certificate has been granted for the use of a building for residential purposes in Nottinghamshire.


Despite the councils contention that there had been a breach of condition proventing a lawful development certificate being issued and there assertion that the 'ten-year rule' applies, the appointed planning inspector confirmed that there refusal of the application was not well-founded.


Indeed, the planning inspector agreed with our points raised including that the relevant period was 4 years beginning with the date of the breach.


A lawful development certificate was therefore issued.
